Introduction

This page explains the Privacy Policy for ASEAN Access: Service Providers and ASEAN Access MATCH.

Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions
  • Administrators refers to the organisations who are members of the national administration teams (also referred to as “Us/Our/We”) in ASEAN Member States and any other organisations or individuals who might be given administration rights to the ASEAN Access MATCH, as official ASEAN Access partner organisations.
  • ASEAN Access refers to ASEAN Access website accessed via https://www.aseanaccess.com/ (can be referred to also as “Platform” within this document).
  • User means the individual or a company accessing the Platform, or other legal entity on behalf of which such individual or company is accessing or using the Platform, as applicable. Only people of legal age and children who have opened and are running a business under the supervision of a legal guardian are to register. Users can also be referred to as “You” within this document.
  • Service refers to any events and matchmaking, and event and matchmaking related services offered and tasks carried out through ASEAN Access MATCH, and the Service Provider databank.
  • Content refers to any content, information, data, contact details and documents, images, videos, price information, and other information of similar nature, published or uploaded on the Platform.
ASEAN Access MATCH Privacy Policy
  1. This privacy policy applies to https://www.aseanaccess.com/ operated by the Administrators.
  2. ASEAN Access complies with relevant data protection and privacy laws in the 11 ASEAN Member States and is in the process of complying with the European General Data Protection Regulation.
  3. This Privacy Policy, together with the Terms and Conditions, explains the general rules and policies governing use of the Service and the Platform, describes what personal information may be collected and how it is used and disclosed to third parties, and outlines the choices available to You regarding Our use of Your personal information and how You can access and update it.
  4. You consent to the collection, processing and storage by Platform of Your personal information in accordance with the terms of ASEAN Access’ Privacy Policy, which is available below. You agree to comply with all applicable laws and regulations, and the terms of ASEAN Access’ Privacy Policy, with respect to any access, use and/or submission by You of any personal information in connection with this Platform.
  5. ASEAN Access respects Your privacy and is committed to protect the personal information that You share with Us. However, We need Your personal information to provide Services through the Platform.
  6. The Administrators aim to protect ASEAN Access’ Users’ privacy and any personally identifiable information that may be collected from and/or provided by Users while visiting and using, as registered users, the Service (either on a computer, laptop or mobile). User data will never be transferred to anyone without the User’s consent.
  7. The Platform is developed and managed by the creative digital agency CON-XO LAB Co., Ltd. and operated with a base in Thailand.
Website Visitors
  1. The Administrators collect non-personally-identifying information of the sort that web browsers and servers typically make available, such browser type, language preference, referring site, and the date and time of each visitor request. This enables the Administrators to better understand how visitors use the Service. From time to time, the Administrators may release non-personally- identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its Service.
  2. For security and threat monitoring purposes, the Administrators also collect personally-identifying information like Internet Protocol (IP) addresses for logged in Users and visitors. The Administrators only disclose logged in Users’ IP addresses to third parties (such as anti-fraud agencies or law-enforcement agencies) under certain conditions outlined in law, if it is necessary and proportionate for lawful, specific purposes. The same circumstances apply to disclosure of personally-identifying information as described below.
Information Collection
  1. When registering on ASEAN Access the personally-identifying information (any information that may be used to identify an individual) Users are asked to enter includes: email address, profile photo, title, full name, gender, job position, personal description, country of residence, and phone number, organisation type, tax number and the number of employees as optional fields. Users also have the option to add their specific address: address, city, zipcode.
  2. Following this, Users have the option to create their organisation profile, with the following information: logo, organisation type and name, country of operation, industry, number of employees, registration number, description, phone number.
  3. Users who then submit their Service provider profile will be require to add company email and company phone number.
How We Use Information Collected
  1. The Platform does not intend to transfer Your personal information to third parties without Your consent, except under the limited conditions described in the section “Information Sharing and Disclosure” below.
  2. The Platform uses information for several general purposes: 1) to fulfil Your requests for Our Services and to be able to offer Our Services to You, 2) to inform You of new events and matchmaking opportunities, 3) receive Your feedback about Our Services, event satisfaction and matchmaking outcomes, 4) to resolve any issues or queries relating to or arising from use of Services, as well as to provide You with better Service and improve the Content of the Platform, 5) to evaluate the number of Users interested in registering as a Service Provider and on ASEAN Access MATCH and track their characteristics, 6) as a publicly funded Service, the Administrators have set performance targets for the Service, and Users’ registrations contribute towards the target, 7) User data is needed to allow the visibility and contact information of Service Providers on the Platform, and 8) generally deliver the Service of ASEN Access.
  3. Once Your profile is validated as Service Provider, the following information will be visible to the public on ASEAN Access: full name, email address and phone number.
  4. The profile You create on ASEAN Access MATCH is visible to other registered Users on ASEAN Access MATCH who have signed up for the same events as you have. Contact information (email address and phone number) and gender is only made visible should You wish to make it visible in Your personal settings, by ticking the required box, but by default, this information is not publicly visible.
  5. If You choose to provide Us with Your personal information, We may transfer that information, within the Administrators, to improve Our Services. Administrators have access to Users’ personal information in the following ways:
    • An administrator only has access to personal data of the Users who are registered as Service Providers in the same country as said Administrator.
    • An Administrator has access only to Users who have registered on ASEAN Access MATCH, if said Administrator has been assigned as the organiser of that event.
    • The exceptions are Administrators with Superadmin status (Office of SMEs Promotion of Thailand and an external consultant contracted to support Administrators in delivery of the Service), who can grant and revoke other Administrators access rights and access (; 2) as well as the ASEAN Access web developers. Superadmins and web developers can see the personal information of all Users at any time.
    • Administrators who have access to Your Personal Information, as granted for specific events and specific time periods, are the following organisations:

  6. The Administrators disclose potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organisations that 1) need to know that information in order to process it on the Administrators’ behalf or to provide Content available on the Platform, and 2) that have agreed not to disclose it to any others. The Administrators will not give or sell potentially personally-identifying and personally-identifying information to anyone, other than to its employees, contractors and affiliated organisations, as described above.
  7. Data Retention Period
    Your data will be stored on the Platform servers for as long as the Platform is in operation, or until You ask for Your data to be removed from the Platform or until You delete your account.
  8. User Rights
    Users of the Platform have the following rights:
    1. the right to be informed about the collection and use of their personal data.
    2. the right of access to their personal data and the right to correct inaccurate or incomplete personal data.
    3. the right to request their personal data to be deleted.
    4. the right to restrict the processing of their personal data.
    5. the right to obtain data that the Administrators hold on them and to reuse it for their own purposes.
    6. the right to object to the processing of their personal data at any time.
    7. the right not to be subject to a decision based solely on automated processing, including profiling.
  9. Surveys
    We may use the Platform or third-party service provider to conduct surveys among Users in order to improve Our Services and offer new services. We will not share the personal information You provide through a survey with any third parties, unless this is communicated to you in writing beforehand.
  10. Testimonials
    We use personal testimonials of satisfied Platform Users on the Platform and through other channels, such as social media, brochures, newsletters, for promotional activities. With Your consent We may post Your testimonial along with Your name and photo. You may withdraw Your consent for Your testimonial to be displayed at any time. When it comes to printed promotional materials, after you withdraw Your consent, Your testimonial will not be used in any future promotional materials that have not yet been published.
  11. Videos and Photos
    During Our events, We might record parts of or the whole event, as well as take screenshots during the event, and a group photo afterwards, to use these for promotion of the Service. The footage will not be used for commercial purposes.
  12. Information Sharing and Disclosure
    Your personal information is never shared outside The Platform without Your permission, except under conditions explained below. On the Platform, data is stored in controlled servers by the web developer, with limited access. The Server used to host ASEAN Access is DigitalOcean LLC, owned by Cloudways located in Singapore, which adheres to GDPR principles of data protection.
    Your information processed in the countries where ASEAN the Administrators are located.
  13. Email
    The Administrators will, from time to time, send You emails to notify You of upcoming events and matchmaking opportunities, share important information and notices before events are happening, or to ask for Your feedback post-event and post-matchmaking, and Your feedback as a Service Provider, should you be published as one. You can unsubscribe from such emails, but as this is an important part of the Platform and the Service We offer, so we recommend that you do not unsubscribe, as doing so can affect your event participation and matchmaking meetings.
  14. Cookies and Tracking Technology
    • Technologies such as cookies, beacons, tags and scripts are used by the Platform. These technologies are used in analysing trends, administering the site, tracking User movements around the site and to gather demographic information about Our User base as a whole. We may receive reports based on the use of these technologies on an individual as well as aggregated basis.
    • We use cookies to remember Users’ settings for authentication. Users can control the use of cookies at the individual browser level. If You reject cookies, You may still use the Platform, but Your ability to use some features or areas of the Platform may be limited. The use of the Platform depends on cookies being enabled for session handling.
  15. Log Files
    We gather certain information automatically and store it in log files. This information may include internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and/or clickstream data. We do not link this automatically collected data to other information We collect about You.
  16. Legal Disclaimer
    We will disclose Your personal information if required to do so by law, such as to comply with a subpoena, or similar legal process when We believe in good faith that disclosure is necessary to enforce Our Terms and Conditions, or in urgent circumstances, to protect personal safety, the public or Our Platform, investigate fraud, or respond to a government request.
  17. Data Security
    • Your account information is password-protected for Your privacy and security. We safeguard the security of the data You send Us with physical, electronic, and managerial procedures. But We still urge You to take every precaution to protect Your personal data when You are on the Internet. Change Your passwords often, use a strong password and make sure You use a secure browser.
    • The security of Your personal information is important to Us. We follow best practices and industry standards to protect the personal information submitted to Us, both during transmission and once We receive it.
  18. Force Majeure
    Neither party, neither the Administrators, the Users nor the Platform web developer will be liable for any failure or delay in performing an obligation under this Privacy Policy that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, breakdown of web host, breakdown of internet service provider, natural catastrophes, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalised lack of availability of raw materials or energy.
  19. Third Party Platforms
    The Platform may contain links to other sites. We do not share Your personal information with those sites and We are not responsible for their privacy practices. We encourage You to learn about the Privacy Policies of those companies/sites.
  20. Changes to This Privacy Policy
    We may update this Privacy Policy to reflect changes to Our information practices. If We make any material changes, We will notify You by email (sent to the email address specified in Your account) or by means of notice on the Platform prior to the change becoming effective. At the end of this Privacy Policy will be the last updated date for Your information. We encourage You to periodically review this page for the latest information on Our privacy practices.
  21. Security Contacts and Procedures
    We take security very seriously and We aim to take immediate action to address serious security-related problems that involve Our Services. Please report any suspected security vulnerability in the Service to Administrators by email: match@aseanaccess.com
